Transfers of IHC Judges Challenged in Supreme Court

ISLAMABAD: The transfer of three judges of the Islamabad High Court has been challenged in the Supreme Court of Pakistan on Thursday.

As per details, the Lahore High Court Bar Association, through senior lawyer Hamid Khan, filed a constitutional petition stating that the transfer of judges is unconstitutional and tantamount to subversion of the independence of the judiciary.

It was argued in the petition that the judicial transfers were unconstitutional and violated Article 2-A of the Constitution.

Lack of transparency in the transfer process was also cited. The petition stated that reasons for the transfers were not clearly provided.

Concerns were raised that the process could affect the independence of the judiciary.

The federal government and the Judicial Commission of Pakistan have been named as respondents in the case.

The petition has requested the court to declare the transfer notifications null and void.

The issue emerged after the notification of transfers of three Islamabad High Court judges was issued a day earlier.

The move triggered concern among sections of the legal community, including lawyers’ bodies.

The matter has been placed before the Supreme Court of Pakistan for review.

Further proceedings are expected to determine whether the transfers comply with constitutional requirements.
