Federal Law Minister Azam Nazeer Tarar has said that an emergency could be imposed in Khyber Pakhtunkhwa if the constitutional requirements for such a step are fulfilled.
Tarar said the Constitution clearly defines the mechanism and conditions for imposing an emergency. He stressed that any such decision would have to be taken according to the provisions laid down in the Constitution.
The statements came amid questions over discussions surrounding the possibility of imposing governor’s rule in Khyber Pakhtunkhwa and whether any formal mechanism was currently under consideration.
He said that if circumstances required an emergency to be imposed in Khyber Pakhtunkhwa and the constitutional conditions were met, then “it should” be imposed and “it will be” imposed.
Tarar reasserted that the Constitution provides a clear framework for dealing with such circumstances and that the relevant constitutional mechanism would determine the course of action.
The possibility of governor’s rule in Khyber Pakhtunkhwa has emerged as a significant political and constitutional issue. The question to the law minister specifically focused on whether a procedure for such a move was being considered and what mechanism would be followed.
Tarar did not provide details of any specific proposal or announce that governor’s rule had been decided. Instead, he emphasized that constitutional provisions would remain the determining factor.
Constitutional Mechanism to Guide Any Decision
The federal law minister repeated that the Constitution was “very clear” on the matter. According to his remarks, any move concerning an emergency or related constitutional measures would depend on whether the circumstances fulfilled the requirements prescribed by the Constitution.
He further said that when the constitutional mechanism required such action, the relevant steps would follow accordingly.
