ISLAMABAD: Detained Dr. Mahrang Baloch, head of the Baloch Yakjehti Committee (BYC), a political wing of the designated terrorist group Balochistan Liberation Army (BLA), has reached the Supreme Court against her arrest.
Her sister, Nadia, filed an appeal against the Balochistan High Court’s decision in the Supreme Court. The high court had referred the case to the provincial administration.
The petition argues that the deputy commissioner had no authority to order the detention. It claims that only the provincial government can do so under the law. She was arrested on March 22.
Earlier, the Balochistan High Court ruled that the petitioner must exhaust administrative remedies first. But the appeal says this is not legally required before seeking help from the courts.
The petition urges the Supreme Court to declare both the detention and the high court ruling unlawful.
Dr. Mahrang Baloch, 32, was arrested in March on charges of terrorism and sedition. After the hijacking of the Jaffar Express, security forces promptly retaliated and killed over two dozen terrorists involved in the Jaffar Express attack. Later, the Balochistan Liberation Army, which took responsibility for the attack, also admitted to killing their members in the security forces’ operation.
The next day, Mahrang Baloch, along with dozens of others, assembled outside the Quetta hospital and staged a protest sit-in demanding the handing over dead bodies of the terrorists. The protesters also attacked the hospital to snatch the dead bodies of the terrorists.
The Police, later, arrested protesters and Mahrang Baloch under the Maintenance of Public Order (MPO).
